Terms and Conditions & Release of Liability

Company: Budmum LLC (hereinafter referred to as "Budmum", "we", "us", or "our")

Services: Landside Airport Assistance and Concierge Services

By checking the agreement boxes on our website, booking a service, or paying the membership fee, you (the "Client", "Traveler", or "Account Holder") agree to be bound by the following Terms and Conditions and Release of Liability (the "Agreement").

1. Scope of Services & Limitations

Budmum LLC ("Budmum", "we", "us") provides landside airport luggage assistance and check-in coordination.

  • No Airside Access: Budmum Buddies cannot go past TSA security checkpoints. Service officially terminates at the airline check-in counter, the TSA entrance, or upon handoff to official airline staff.
  • No Transportation: We do not provide ground transportation. Clients are solely responsible for booking rides (e.g., Uber, Lyft) to and from the airport.
  • No Equipment Provided: We do not provide wheelchairs. Clients must request wheelchair assistance directly from the airline.

2. Medical Disclaimer & Waiver of Duty

Budmum Buddies are not doctors, nurses, or licensed caregivers. We provide logistical companionship and physical assistance with luggage only. You represent that the traveler has the requisite physical capability to travel. Most of our care recipients are elderly and increasingly susceptible to illness and injury. Budmum cannot prevent these occurrences and puts forth its best efforts to provide non-medical assistance and companionship. You explicitly waive any expectation of medical assistance, medical transfers, or medication administration.

3. Booking, Cancellations, and Refunds

  • Advance Notice: Bookings and date/time changes must be requested at least 24 hours in advance. Last-minute changes are not permitted.
  • Refund Policy: If the airline cancels the flight in advance, a full refund will be issued. If you cancel the booking within 6 hours of the flight, no refund will be provided, as our Buddies organize their daily schedules around these commitments.
  • Traveler Info: Increasing the number of travelers from the original booking will incur an additional cost.

4. Client Communication Responsibilities

You agree to maintain communication via phone, SMS, or Google Meet to coordinate the exact curbside meeting point. You must provide the vehicle's make, model, color, and license plate, or a live rideshare tracking link. Failure to communicate resulting in a missed connection is the client's sole responsibility and is non-refundable.

5. Assumption of Risk & Release of Liability

In consideration of the services provided, you voluntarily assume all risks associated with airport navigation, including but not limited to physical injury, slip and falls, missed flights, and property damage. To the fullest extent permitted by California law, you, on behalf of yourself, the traveler, and your assigns, hereby fully and forever release, waive, and discharge Budmum LLC, its owners, and its contractors from any and all claims, damages, or causes of action resulting from ordinary negligence during the provision of our services.

6. Waiver of California Civil Code Section 1542

You acknowledge that you are waiving the rights and benefits of California Civil Code Section 1542, which states:

"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

You expressly, knowingly, and intentionally waive any protections of this section or any similar state or federal statute.

7. Indemnification & Limitation of Liability

You agree to indemnify and hold harmless Budmum LLC from any claims, liabilities, or expenses arising out of your breach of this agreement or failure to arrange proper airline assistance. In no event shall Budmum LLC be liable for indirect, consequential, or punitive damages (such as the cost of missed flights or replacement tickets). Maximum liability for any claim shall not exceed the amount paid for the specific booking.

8. Governing Law

This agreement shall be governed by the laws of the State of California.
